What are the laws on police using pepper spray?

I was an innocent bystander at about 10 yards from the spot where pepper spray was let off, but I'm bad enough causing an asthma attack, and I wonder if the police are required to responsible for this attack? I live in Australia so the laws here may be different from those of you who live elsewhere.
